I just find it unreasonable especially when the divorce was brought up by her and she was the one leaving us behind.

I know for my kid, everything is not a problem. Coz we want to give him the best of everything in this world.

I just like to know the meaning of "care & control" under the Singapore laws.

Care and control is the right to have the children live with you, and to make everyday decisions about them. For practical reasons, care and control normally lies with one parent.

My husband and I are going through a divorce. There were some issues but cut the story short, we recently bought a flat with his CPF n mine. Now I would like to take over the flat. He said that I don't have to return his cpf monies. Can he do that? If I want to take over the flat, somehow I have to return his cpf right? Can someone help me with this?

Do you have children? Whether you are allowed to take over the flat oso depends on whether do you satisfy the HBD eligibility requirements. If you do not have a family nucleus after the divorce the flat must be sold or returned to HDB.

Well since he willing to potong his cpf portion paid for the flat to you then what you worry? Only thing is, he might have to top back up to CPF the amount he potong to you. After all that is how I got screwed by the fucking familee cock when i was ordered to transfer flat to my ex including what I had paid for in CPF.

He might have to cough back the amount back to his CPF account even though he has "given" me his for the flat? No fucking logic. The way the garment do things have no logic. I do not have children. We just bought the flat which means I still have to fulfill the five years eligibility before I can proceed with the divorce, don't I? Wtf! It also ses very unfair to my future ex hubby that he has to return the amount back to his CPF. That's double whammy.

Well that was the double whammy i got hit with back then but honestly don't know if they have changed things around? In any case CPF money though its your own hard earned money put inside the board for them to squander away, the ironic thing is you don't own it. The board rationale is very simple, money is meant for your retirement, hence whatever you took out you must put back in if you sell off your flat. Technically in this case your soon to be ex hub did not sell but rather offer to "give away", so naturally he has to top up the same amount put in.

As in my case, I did not willingly "give away", it was the fucking familee cock that ordered me to "give" it away to my ex...that left me in double jeopardy when CPF chase me back for the same amount that was "given away, failing which they would not let me remove my name from the flat and yet fucking familee cock gave me three months to get my name out...short of selling my ass to get the money, luckily i managed to gather enough money to pull the whole thing through...

For your case may be a bit problematic if you file for divorce now you cannot sell your house yet. But if you are already divorce, both of you cannot keep the house...only option is perhaps do what my friend did, file for separation wait out the 5 year period then file..

Now that you feel sorry for your soon to be ex on his possible financial predicament, don't you think you ought to sympathize with him and reconsider your decisions and seek reconciliation? I am not saying you should look from it just from the financial point but I am sure there was something you seen in each other that got you together in the first place. So perhaps work on that little spark and make it grow into a wild fire...

You should be helping him to seek rehabilation for his gambling addiction and not hang him out to dry..... You did take your marriage vows didn't you?

From your post I can see that you belong to the category of women that sees divorce as a solution and easy way out instead of working with your partner to see through the hardship period and overcome whatever is causing it.

I can see why you are so pissed but from the sound of it, you do sound like you also feel sorry for him...if you seriously want to hold on to marriage then both of you need to sit down for a heart to heart talk...first step towards rehabilitation is asking him to apply for exclusion order..at least that will go towards some way in curbing his addiction...the rest is really how determined both of you are in seeing through the thick and thin part....

I take offence that you would assume that I am one of those women who uses divorce as your so called 'easy way' out. My family and I have helped him many times and it has been a very frustrating journey to get him to keep his words n trust him. Of course, unlike some of the bitches that you could have met, I am not as hard hearted. I will consider all options and I ain't one to leave him high and dry.
