Rape and statutory rape

In Singapore, if you have sex with a girl under 14 years old, it is regarded as statutory rape under the Penal Code. Why is it called statutory rape? This is because the Penal Code regards it as rape even if the girl, her father, mother, grandfathers, grandmothers, guardians, etc all sign the consent form.

If the girl is above 14, the Penal Code will only regard sexual intercourse between a man and woman as rape if the woman did not consent to it or her consent was obtained by force or fear.

Now that is not the end of the story. Under the Women's Charter, for the protection of minors, it is an offence to have sex with a girl under the age of 16 even if she consents. The difference between statutory rape under the Penal Code and under the Women's Charter is the punishment that the Court can mete out to the offender.

Under the Penal Code, only a man is capable of raping a woman. If guy does the asshole bandit on another unwilling chap, that is not defined as rape as far as the Penal Code is concerned. There is another charge for this.

Also, if a woman forces herself on a man, that is also not defined as rape. I don't think there are any provisions in the Penal Code that covers such a situation. Therefore, if that 500-pound monster living next door to you suddenly decides to make you her dildo, well too bad for you then.

Another point to note is that the Penal Code does not make it an offence if a woman have sex with a boy under the age of 14. Needless to say, there is nothing in the Women's Charter on this.


Having sex with prostitutes

Under Singapore law, it is not an offence to engage the services of a prostitute. In fact, prostitution in itself is not illegal. By prostitution, I mean a person offering sexual favours to another person for some benefits, either in cash or in kind.

What is illegal is if the prostitute is found to be soliciting in public. The TG at the legal houses in GL are a good example of not soliciting in public. They just sit there and wait for customers to come. The FLs drifting along the streets are committing an offence each time they ask the John walking by if he wants to go up to the room for a good time.

If a guy decides to engage the services of a FL, he is not committing an offence. There is a little grey area whether by engaging the services of a FL, whether is the guy abetting the offence of soliciting in public. I frankly doubt

Miscellaneous Offences Act

This includes public mischief, nuisance, etc. I remember there were several people charged under this Act in the past when they decided to parade nude around their respective homes.

Silly law which should be repealed if you ask me. They should charge the guy who is looking into the neighbour's house.


Conclusion

As a guy, if you want to enjoy the scent of a woman in Singapore, so long as she is above 16 years of age, consents to the act, and the act is done behind closed doors (and draw the curtains too for heaven sake!), it is perfectly ok even if the guy is still wearing diapers and sucking on pacifiers.
