The First Secretary of Information and Public Service of the Indonesian embassy here, Eka Suripto, said the case had been transferred to the Indonesian Justice Department. "In many cases of Indonesians coming to Malaysia without proper work permits, they are jailed. This is reciprocal," he said. KPMG was not told why its two employees, Choo Yao Chin and Raimala Sivalingam, were held. They were arrested 20 days after they arrived in Sulawesi on July 27 to carry out a due diligence on a mining company, PT International Nickel Indonesia, located in Sorowako. The job was commissioned by a Canadian company, Inco Ltd. Choo is being held with hardcore criminals at the police detention centre in Makassa while Raimala is being held at a hospital. KPMG managing director Datuk Gan Ah Tee said the company had instructed its lawyers as well as those from Indonesia to check the relevant laws and documents to ascertain if the two had breached any law. "They (Indonesian authorities) should take action against us (KPMG) if we have done anything wrong instead of putting innocent people in detention. "They are professionals, not terrorists." The Malaysian embassy, which is headed by the charge d’affairs Adenan Othman, said it was doing everything possible to free the two. Businessmen familiar with Indonesian laws said one was not required to apply for a work permit if the visit was for kunjungan usaha (which loosely translated means fact gathering). Checks show that former President Megawati Soekarnoputri’s office had in 2003 issued a directive allowing Malaysians and citizens from 10 countries to be exempted from applying for visas if they were visiting the country for that purpose.
