In my opinion, they should be prosecuted (and be buried in HELL!) for such an act on any girl (and to do it to such a sweet girl) , even if they are in the trade. On the other hand, Mei Zi have to think about the repurcussions.........not only here but back home as well. This is something a girl of her age will need alot of advice to decide. So bros who have contributed on the legal aspects..........thank you on her behalf and I sincerely hope she can come out with a decision that she can live with after this is over and done with.............

Rape is already the more serious crime of the 2. They will be charged for Rape. Btw....Volunatarily Causing Hurt is a civil sue. Police does not have the power to arrest or investigate any person for it unless being authourised by the judge. It is also a non-seizeable offence unless it happens infront of a PO.

VCGH? You need to have a fracture leg/arm or broken nose and have to spend about 20 days in serious pain before it can be classified as VCGH. In this case, where got VCGH?

If you do that, it will cast doubt on your rape report later on. The 2 guys can alleged that the gal tried to blackmail them but fail and thus make a false allegation of rape against them.

They can always claimed that they had agreed a certain sum of money to engage her service. The package include rough sex with 2 of them. However, after the deed has been done, she demanded for extra $.

Don't forget that this lady is a FL and not a normal type of innocent and naive gal. Once her occupation is established by the defence lawyer, the case might be throw out of court. The benefit of the doubt might be given to the 2 guys instead of the poor gal.

here's my view and advice;-

under the singapore law, Section 375 of the Penal Code states

'A man is said to commit 'rape' who, except in the case hereinafter, has sexual intercourse with a woman under circumstances falling under any of the five following descriptions:

a) against her will;

b) without her consent;

c) with her consent, when her consent has been obtained by putting her in fear of death or hurt;

d) with her consent, when the man knows that he is not her husband, and her consent is given because she believes herself to be lawfully married or to whom she would consent;

e) with or without consent, when she is under fourteen (14) years of age.'

Section 376 determines the punishment and states

Subsection (1):

'Subject to subsection (2), whoever commits rape shall be punished with imprisonment for a term which may extend to twenty (20) years, and shall also be liable to fine or to caning.'

Subsection (2):

'Whoever, in order to commit or to facilitate the commission of an offence of rape against any woman -

a) voluntarily causes hurt to her or to any other person;

or;

b) puts her in fear of death or hurt to herself or any other person,

-and whoever commits rape by having sexual intercourse with a woman under fourteen (14) years of age without her consent, shall be punished with imprisonment for a term of not less than eight (8) years and not more than twenty (20) years and shall also be punished with caning with not less than twelve (12) strokes.'

Article 90 defines consent and states

'A consent is not a consentas is intended by any section of this code -

a) if the consent is given by a person under fear of injury, or under a misconception of fact, and if the person doing the act knows, or has reason to believe, that the consent was given in consequence of such fear or misconception; or

b) if the consent is given by a person who, from unsoundness of mind or intoxication, is unable to understand the nature and the consequence of that to which he gives his consent; or

c) unless the contrary appears from the context, if the consent is given by a person who is under twelve (12) years of age.'

Pls advice her to make a police report and have e two men taken to task first. PM me if you need further advice.

Of course there is no such charge such as rape with VCH/VCGH..but there are two offences being comitted by reading the facts mentioned by threadstarter. He will be Charge with rape but VCGH will be taken into consideratinon if proven VCGH/VGH. Even if rape cannot Jalan, they can proceed with VCGH.

From my understanding, a permant scar with be sufficient to substatiate it as a VCGH case....not necessary broken nose or legs or hospitalised for 20 days.

As for VGH...this will be the last resort liao if both the offences cannot jalan.

I think at this point of time, we are not talking about seizable offence or not.
Like you mentioned, a VCH can also be activated once the judge pass the order.

At the end of the day, the most important thing is to let threadstarter and his FL friends knows what course of action they need to do and expect.

Girl - CONFIRM kenna charged for being FL.
the 2 rapist - maybe will kenna charge with rape, maybe not.

So why not might as well contact the 2 bastard and get money from them which is what she intend to when she was doing Fl right? only if this doesnt work out then go and make a police report and sent the 2 bastard to cell.

yes she should not keep to herself... but going the law/police doesnt solve everything.. use it as a last resort. there are better way to solve problems right?

like i say go report to the police if nothing else can be done..

but you might be right .. we also dont know whether this case real one or not... maybe it was DNAT who was raped!
