Re: Issue with ICA

Bro Shysaint, relax...no need to get too agitated. I think Bro Icalaw101 think too highly of lawyer ability.

Bro Icalaw101, sometimes I also dont quite understand some of ur posts. Ur last previous post seems too be getting out of hand thou. Nobody in their right mind will post the EXACT letter with sensitive info not censored away. And your reply seems to contradict what u preaching.

Anyway, ICA got a few law that is very powerful if I remembered correctly. If they decide to use that law, no lawyer in the country can save the situation.

Re: Issue with ICA

Engaging lawyers do not enhance your chances even one iota, period.

Best chance is be honest when applying to ICA. If and when kenah reject, go through your MP repeatedly until you get approval for a SVP. If extension for SVP or subsequent application for PR is not granted, go through same process with MP or even the anchor Minister in your GRC.

It will be tiring and frustrating. Endure it. Making it a routine in your life helps to make it tolerable. I know of at least one example where the fella's wife was caught and sent back for working illegally in a KTV. After repeated appeals through the MP she's now in SG and bore the fella kids. Happy family now.

Most important is honesty.

Re: Issue with ICA

dear bros..

my vietnam gf and i are getting married in singapore in may this year. currently she is now in vietnam. i would be going over there in april and together we would be coming over to singapore in may.

before going to vietnam, i would be bringing in the rom documents over so that i can show to the ica officials at changi when we are coming back to singapore. i have also bought a return ticket for her just in case ica officers ask her to show the return ticket. so together with the return ticket and rom documents, i would like to ask are there any other things i should bring to show the ica officers at changi when me and my vietnam girlfriend are coming over to singapore? For info, so far she has not been issued a refusal entry into singapore.

many thanks to all bros out here who share their knowledge..

Saying that the use of a lawyer does not help is not justified since your cited example did not involve a lawyer's appeal. In fact, there is not an iota of evidence to support that contention.

This is not a poll thread to say whether a lawyer appeal works or a DIY/MP appeal rocks.

Even if when you are sick, you can choose not to see a doctor, your body may recover on its own. Some self-medicate and some see the doctor immediately. Some prefer to test his body's resistance powers and see how it recovers without any medicine. If you recover on your own, do you say "blah, that western medicine does not work, you do not need that medicine, you can recover on your own. That medicine is useless."

Re-read this thread from the start and see the REPEATED and FRUSTRATED lamenting about the failures encountered by the DIY appeal and the MP appeals. Compare this with the comments on a legal appeal.

Open your eyes and see, the world is not flat anymore. There is this AVENUE of a legal appeal to ICA to solve the problem.

You are well prepared already. ICA may ask her orally sometimes at changi or checkpoints where would she be staying in Singapore and when is her ROM date, time and location.

Congrats in advance.

Exactly. 1 of my frd gf was caught during a raid and my frd ask a lawyer to wrote an appeal letter but to no avail. The letter was simply brushed aside. My frd gf was ask to leave under extradition act, and as we noe the act was a very powerful 1. It can skip all normal protocol and regulations with no appeal etc allowed

From ICA and AV perspectives, a lot of matters are considered. The circumstances of the arrest differ from one case to another.

ICA does not repatriate the girl under the Extradition Act. This act applies to the following category only.

"fugitive" means a person who is accused of an extradition crime that is alleged to have been committed, or convicted of an extradition crime that was committed at a place within the jurisdiction of a foreign State or a declared Commonwealth country or of a part of such State or country and is, or is suspected to be, in Singapore;

"extradition crime" , in relation to a declared Commonwealth country, means an offence against the law of, or of a part of, a declared Commonwealth country —

(a) the maximum penalty for which is death or imprisonment for not less than 12 months; and

(b) the act or omission constituting the offence or the equivalent act or omission would, if it took place in or within the jurisdiction of Singapore, constitute an offence against the law in force
in Singapore that —

(i) is described in the First Schedule; or

(ii) would be so described if the description concerned contained a reference to any intent or state of mind on the part of the person committing the offence, or to any circumstance of aggravation, necessary to constitute the offence;

I further add that prostitution is not a extradition crime as the punishment is much much lower. The repatriation is done under the Immigration Act. See my earlier posts.

I hope this knowledge with ICA helps to clear your fren doubts.

See if your fren is willing to share more info about the circumstances of the raid and whether he is keen to show the contents of the lawyer appeal letter with the names of parties and law firm name blanked out and file references therein blanked out. We can study it together and see if all bros here can help him out. Better still ask him to join sbf.

If he is too shy, then never mind.

solicit prostitution is a crime in sillypore and applies to sinkies too unless you are licensed...if you are foreigner enter sillypore with a tourist visa caught in soliciting prostitution will be considered a extradition crime...tourist visa is not allowed to engage/solicit in any work for money...if caught the foreigner will be repatriated under the extradition act...

most of the time these prostitution will also involved loanshark, narcotics and triads...so quite complex charges can be meted out if the police or ICA wanted to do so...just my humble 2 cents worth...

Congrats in advance.
I thought for a while you going to ask him to get a lawer for this case...haha..hope you can accept both positive and negative comments so that we can discuss...not all the time you think you are right and single sided aspects of the law....

when anyone broke the law and caught...the sentence will be meted out by the presiding judge...no two ways about it...engage lawyers will only try to appeal for lighter sentence...foreigners will be repatriated after any jail sentence...

Re: Issue with ICA

Constructive feedback is appreciated by me and I also try to see both sides. I have never say that DIY appeal or going to MP is doomed to fail. I have been clear on this subject of legal appeal. there is this appeal process and it is worth considering. Substance of the appeal, background of the ban are factors considered by ICA. If the DIY specialist presented it and fails, MP presented it and fails, then approach the legal specialist.

For those brothers who used MP appeal, you would recall the long q to see MP and the brevity of their letter of appeal. In fact when the MP appeal does fail, the MP does not contact you to meet the MP again and explore the remedial options. Usually, you will wait, apply and appeal again.

No one can say that you are wrong to do this and repeat the process with patience and honesty. I only mentioned in my past posts that there is a LEGAL AVENUE that may be considered.

I am interested in sharing info and learning from fellow bros. Shall I say peace?
