Malaysian lawyers urge government to save Sarawakian on death row in Singapore

KUALA LUMPUR — The Malaysian government should step in to help remove Sarawakian Kho Jabing from Singapore’s death row if the courts there dismiss his bid to review the death penalty for his murder conviction, lawyers in Malaysia said.

The three professional bodies representing all the lawyers in Peninsular Malaysia, Sabah and Sarawak said they were “extremely concerned” with Kho’s fate and pushed for a bid to have his punishment commuted to life imprisonment.

“In the event the application fails and the death sentence on Kho Jabing is maintained, the Malaysian Bar, Advocates’ Association of Sarawak and Sabah Law Association call on the Malaysian Government to support any further application for clemency, and urge it to do its utmost to intercede with the Singaporean authorities to commute Kho Jabing’s death sentence to one of life imprisonment,” the three professional bodies said in a rare joint statement.

In 2010, the 31-year-old Kho who worked as a labourer in Singapore was convicted and sentenced to death for the murder of 40-year-old China national Cao Ruyin.

When Singapore’s scrapping of the mandatory death penalty for murder came into force in 2013, however, Kho was deemed eligible to apply for resentencing. His sentence was later commuted to life imprisonment and 24 strokes of the cane by the Singapore High Court.

However, a 3-2 decision at the Singapore Court of Appeal last January after the prosecution appealed sent him back to death row.

Kho was scheduled to hang on Nov 6, but was awarded a temporary reprieve less than 24 hours to his execution after his lawyer filed a criminal motion at Singapore’s Court of Appeal on Nov 4 for remittance.

Yesterday (Nov 23), Singapore’s Court of Appeal heard the motion to review Kho’s death sentence and reserved its judgment to a later date.

The stay on his execution remains in force until the decision is delivered. THE MALAY MAIL ONLINE
